Ts & Cs FOR SERVICING AND REPAIRS

  1.       Definitions

1.1.     “The Company”, for the purposes of this agreement, being ABS Auto Repairs Limited.

1.2.     “The Customer”, for the purposes of this agreement, being the person contracting for services to be supplied by “The Company”.

1.3.     “Services” means any such service undertaken by “The Company”, 

  1.       Contract

These terms represent the whole Contract between “The Company” and “The Customer”.

  1.       Interpretation

The singular shall include the plural and vice versa.

  1.       Enforceability

These terms and conditions are hereby declared enforceable by “The Company” and shall nonetheless, remain in full force and standing effect.

  1.       Variation

Any ‘agreed’ variation between “The Company” and “The Customer” shall be deemed to be an amendment of the Contract and shall not constitute a new contract.  Such amendments will either be made via written or verbal form to “The Customer” by “The Company”.

  1.       Estimates

6.1.      “The Company” reserves the right to alter charges in order to meet any variation(s) in price, whether that be due to an increase in materials, wages, or cost from any other cause outside of “The Company’s” reasonable control.

6.2.     Should any additional work or materials be found necessary in the course of the repairs or any subsequent testing, it will be necessary to make extra charge(s), as appropriate.

  1.     Use of the “The Customer’s” Vehicle(s)

This agreement hereby authorises “The Company” and its employees and agents to use ”The Customer’s” vehicle(s) on the highway and elsewhere, for such purposes in connection with the work advised. “The Company” therefore undertakes to take reasonable care of “The Customer’s” vehicle(s).

  1.       Paintwork Repairs

8.1. Where new paintwork is required and the metal work is found to be rusted, every reasonable precaution will be taken to prevent this penetrating through after completion of painting however, no guarantee can be given in this respect. 

8.2. Every endeavour will be made to match the existing paint colour scheme(s) however, no guarantee can be given of a perfect colour match.

.9.        Delivery

“The Company” shall give an estimated time for the repair of a vehicle(s), although “The Company” cannot accept responsibility for delays.

  1.     Liability

Vehicles, including components, fittings and contents are left with “The Company” entirely at “The Customer’s” risk. “The Company” shall under no circumstance, be liable for loss or damage thereto, or for any delay in completing the service or repairs.

  1.     Payment

Payment in respect of any services, work under-taken, or other charges thereunto assigned by “The Company,” shall be made prior to and in full, by “The Customer” before taking possession of the vehicle(s).

  1.     Lien

“The Customer” acknowledges that “The Company” has a legal lien upon any vehicle(s) left with “The Company” until all costs due are paid in full.  For the purposes of this agreement, such costs are not limited to: the cost of repairs, costs for sourcing parts and components, the cost of parts and components, storage costs for storing “The Customer’s” vehicle(s).

  1.     Storage Charges & Release Fees

 “The Company” reserves the right to make a reasonable daily charge for the storage of the vehicle(s), which will remain payable in full before the vehicle(s) is released.  If storage charges are applicable having notified “The Customer,” a further release fee may also become applicable if the duration of storage of the vehicle(s) exceeds three months.

  1.     Disposal of Uncollected Goods

Any vehicle(s) which is not collected by “The Customer” and in respect of which, any outstanding payment for repairs, storage costs and any other applicable costs have not been paid in full following three calendar months after “The Customer” had first been notified; such vehicle(s) may be sold by “The Company” and the cost of the repairs, storage charges, and other applicable charges will be deducted by “The Company” from the net proceeds of the sale of the vehicle(s).
